Terms of Agreement.

When you use our website to place an order with us, these Terms and Conditions of Business will constitute a legally binding agreement between you and us. It is your responsibility to carefully read these Terms and Conditions of Business before using this website. Your use of the momentsbyalexa.com website is contingent upon your acceptance of our Privacy Policy and the following Terms and Conditions. Use of the momentsbyalexa.com website will be considered acceptance of the Policies. If you do not agree to the Terms and Conditions of Business contained in the following pages, then you may not use momentsbyalexa.com website. Please note that Moments by Alexa has the right to modify these Terms and Conditions of Business and, thus, you should review them periodically.

  1. Moments by Alexa reserves the right to reject any Order without the obligation to assign any reason for so doing.
  2. Moments by Alexa has a policy of continuous product development and reserves the right to amend the specifications of any of the Goods without prior notice.
  3. Moments by Alexa endeavors to display and describe as accurately as possible the printed colors of the Goods which appear on its website, but cannot undertake to give any assurance that the colors of Goods supplied will exactly match those displayed on the User’ s monitor.
  4. By placing an order, you acknowledge and agree that the Moments by Alexa heart will be included on the design of every custom frame design. The icon will be positioned as shown on our web design tool. We reserve the right to alter the color of this icon to ensure it is clearly visible against the User’s design. This color change, if necessary will be at the sellers discretion and will take place after an order has been placed as such will not be visible in any proofs created prior.

Customer Policy Compliance 

Users of the Moments by Alexa, whether or not End Users, may not use the Photo-Finishing Services to process prohibited and restricted content, which includes content or other material that Moments by Alexa believes:

• Is abusive, deceptive, pornographic, obscene, defamatory, slanderous, offensive, contains explicit nudity or is otherwise inappropriate;

• Comprises copyrighted material used without the express permission of the owner;

• Violates or encroaches on the rights of others;

• Contains viruses, worms, corrupt files, Trojan horses and other forms of corruptive code, or any other content which may compromise the Service;

• Advocates illegal activity;

• Harms anyone, including minors; or

• Provides a link to anything that would violate any of the above.


Any content discovered and deemed in the sole discretion of Moments by Alexa to be in violation of Title 18 of the United States Code, Sections 2251 et seq., or such other applicable law in effect or that may be adopted, may be reported and disclosed to appropriate law enforcement agencies by Moments by Alexa.


All Content (whether private or public) that is processed on the site is the sole responsibility of the person who submitted it. Thus, users are responsible for their Content.


As a condition to use of the Services, Developer will require its Developer Customers to (a) represent and warrant that Developer Customer either owns the content it submits or has written permission from the copyright owner to make such content available to the service, and (b) grant Moments by Alexa a perpetual, universal, non-exclusive, royalty-free right to copy, display, modify, transmit, make derivative works of and distribute any submitted content, solely for the purpose of providing the Service.


Developer and Developer Customers may not submit any content for processing without the written consent of the owner of such content. Users of the services are solely responsible for any copyright violations that may incur as a result of the user’s activities on the service. End Users shall also comply with Moments by Alexa policies, procedures, terms, and conditions, as set forth by Moments by Alexa for its own customers that are published on Moments by Alexa’s website at MomentsbyAlexa.com, which Developer shall provide its End Users with a URL listing Moments by Alexa website prior to the End User placing an order.
